Terms and Conditions
Welcome to Fit Bod Institute, an online fitness coaching service. By using our services, you agree to the following terms and conditions:
1. **Liability Waiver**: Fit Bod Institute and its coaches are not liable for any injuries, accidents, or health issues that may arise during or after your participation in our fitness coaching program. By using our services, you acknowledge that you are undertaking any physical activities at your own risk.
2. **Personal Health and Medical Conditions**: Before starting any fitness program with Fit Bod Institute, it is your responsibility to disclose any existing medical conditions, injuries, or health concerns to your assigned coach. If you have any doubts about your ability to safely participate in the program, consult with a qualified healthcare professional before proceeding.
3. **Age Requirement**: To use Fit Bod Institute's online coaching services, you must be at least 18 years of age or have obtained parental or legal guardian consent.

4. **Minimum 3-Month Commitment**: Upon signing up for Fit Bod Institute's online fitness coaching, you agree to a minimum commitment of three months from the start date of your coaching plan.
5. **Cancellation Policy**: After the initial 3-month commitment is met, you may cancel your coaching subscription by providing a 30-day written notice to Fit Bod Institute. Cancellations within the 3-month initial commitment period will not be accepted.
6. **Payment and Fees**: You are responsible for the timely payment of the coaching fees as agreed upon during the signup process. Any applicable taxes will be added to the coaching fees. All prices are in USD.
7. **Refunds**: Fit Bod Institute does not offer refunds for the coaching fees paid. This includes unused time on paid-in-full products. However, if there are exceptional circumstances, our team will review your case on an individual basis.
8. **Model Release**:
By participating in coaching services provided by Fit Bod Institute, you agree to allow Fit Bod Institute to use your photographs, videos, and/or digital images (collectively referred to as "images") taken before, during, and after your coaching sessions for promotional purposes. This includes, but is not limited to, sharing these images on social media platforms, website galleries, marketing materials, and other online and offline publications.
9.**Personal Data and Privacy**: Fit Bod Institute values your privacy and will handle your personal data in accordance with our Privacy Policy. By using our services, you consent to the collection, processing, and storage of your personal information as outlined in the Privacy Policy.
10. **Coach's Discretion**: Fit Bod Institute's coaches are certified professionals, and they will work with you to develop a customized fitness plan tailored to your goals and abilities. However, should a coach determine that a specific diet or exercise regimen may pose health risks to you, the coach reserves the right to modify the plan in your best interest.
11. **Intellectual Property**: All content, materials, and intellectual property provided to you during the coaching period are the exclusive property of Fit Bod Institute. You are not allowed to reproduce, distribute, or share these materials without prior written consent from Fit Bod Institute.
12. **Termination of Services**: Fit Bod Institute reserves the right to terminate coaching services for any client found violating these terms and conditions or engaging in inappropriate behavior towards our coaches or other clients.

13. **Return and Fulfillment Policy**: Digital products such as ebooks are not eligible for refunds. Physical products such as shirts and tumblers are not eligible for refunds. However, if there is an issue with a physical product please email info@fitbodinstitute.com so we can resolve the matter. All coaching services are fulfilled online. Training programs, nutrition plans, and competition protocols will be communicated via the Fit Bod Institute app. Prior to being set up on the app, communication with your coach will occur either via email, Zoom or by phone.
13. **Fit Bod Institute Privacy Policy**: We will never sell your information to anyone for any reason, ever. Fit Bod Institute complies with all PCI Standards.
14. **Modifications to Terms and Conditions**: Fit Bod Institute may update these terms and conditions from time to time. The revised version will be posted on our website, and your continued use of our services after the changes are made constitutes your acceptance of the updated terms.
